Welcome to Total Fitness. By accessing or using our website, mobile application, purchasing products from our nutrition store, or using our gym facilities, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Total Fitness ("we," "us," or "our").

2. User Accounts

2.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

2.2 Account Eligibility

You must be at least 18 years old to create an account and use our services. By creating an account, you represent that you meet this age requirement.

3. E-Commerce and Product Orders

3.1 Product Information

We strive to provide accurate product descriptions, images, and pricing. However, we do not warrant that product descriptions or other content is accurate, complete, or error-free.

3.2 Orders and Payment

• All orders are subject to acceptance and availability
• We reserve the right to refuse or cancel any order
• Prices are in Indian Rupees (₹) and include applicable taxes
• Payment is processed securely through Razorpay
• You must provide valid payment information

3.3 Shipping and Delivery

Shipping terms and delivery times are outlined in our Shipping Policy. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

4. FitPoints Loyalty Program

Our FitPoints loyalty program is subject to specific terms and conditions. For complete details, please see our FitPoints Program Terms.

Key points include:

• Prepaid supplement orders earn 5% of the amount paid back as FitPoints (5 FitPoints per ₹100). Cash on Delivery orders do not earn points
• Prepaid gym memberships, one-time or auto-renewing, earn FitPoints at the same rate, credited when each payment is received
• Points expire 60 days from the date they are credited
• FitPoints are redeemable on supplement orders only, up to a maximum of 10% of the order's payable amount. They cannot be used for gym memberships
• We reserve the right to modify or terminate the program
• Points have no cash value and are non-transferable

NOTE: Point economics are subject to change at our discretion.

5. Gym Memberships and Facilities

Gym membership terms are detailed in our Gym Membership Terms. By purchasing a membership, you agree to:

• Follow all gym rules and regulations
• Use equipment properly and safely
• Respect other members and staff
• Maintain appropriate gym attire
• Not hold us liable for injuries (subject to applicable law)

6. Coupons and Promotions

• Coupons and promotional codes are subject to specific terms
• Coupons may have expiration dates and usage limits
• Only one coupon can be used per order unless stated otherwise
• We reserve the right to cancel or modify promotions
• Coupons cannot be combined with other offers unless specified

7. User Content and Reviews

When you submit reviews, ratings, or other content:

• You grant us a non-exclusive, royalty-free license to use your content
• You represent that your content is original and does not infringe rights
• You agree not to post offensive, defamatory, or inappropriate content
• We reserve the right to remove or edit content at our discretion
• Reviews must be honest and based on genuine experience

All content on our website and app, including text, graphics, logos, images, and software, is the property of Total Fitness or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

• Use our services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Use automated systems (bots, scrapers) without permission
• Impersonate others or provide false information
• Engage in fraudulent activities
• Violate any applicable laws or regulations

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• Our services will be uninterrupted or error-free
• Defects will be corrected
• Our services are free of viruses or harmful components
• Results from using our services will meet your requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL FITNESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Total Fitness, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Request by law enforcement
• Extended period of inactivity

Upon termination, your right to use our services will immediately cease.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
